Permitted development on designated land: the Cotswolds, National Landscapes and conservation areas

On designated land, permitted-development rights are tighter, and an Article 4 direction can remove them. Much of our area is in or beside the Cotswolds National Landscape.

In short

Designated land means a National Landscape (the current name for an Area of Outstanding Natural Beauty, which includes the Cotswolds), a conservation area, a National Park or a World Heritage Site. On designated land, permitted-development rights are restricted: side extensions and some outbuilding positions are removed, cladding rights are limited, and larger projects that would be permitted elsewhere need an application. An Article 4 direction can remove permitted-development rights entirely for specified work in a specific area. Always confirm the status of a property before you start.

Designated land is the single biggest reason a garden project in our area needs more than the standard rules suggest. The Cotswolds is a National Landscape, the protected status that used to be called an Area of Outstanding Natural Beauty, and most of the historic towns and villages also have conservation areas.

On designated land the permitted-development rights are narrower. Some work is removed altogether, such as certain side extensions and outbuilding positions, and some materials and cladding are restricted. The aim is to protect the character of the place, which is exactly why people want a garden here in the first place.

The sharpest tool is an Article 4 direction. This is a council order that removes specific permitted-development rights in a defined area, so work that is permitted a mile away needs an application here. We confirm the designations on a property at the start, before any design assumes a right that does not exist.
